Terms and Conditions
By accessing or using the Biontel.ai M2 (Morbidity and Mortality) Tool provided by Codewave/Aihiki, including any software, data outputs, or related materials (collectively the “Tool”), Users agree to be bound by these Terms and Conditions. If Users do not agree to all terms, do not access or utilize this Tool.
Use of the Tool –
- The Tool is intended solely for use as an analytical second opinion to assist with mortality and morbidity analysis based on the User’s own patient data. It is not a substitute for medical judgment. Any outputs do not constitute medical advice or treatment recommendations.
- Users may only input or analyze data for purposes for which they have legal authorization. Codewave/Aihiki is not responsible for ensuring compliance with any regulations related to patient privacy, protected health information, or medical analysis. Users retain sole responsibility for compliance with all applicable laws.
- Users will not input identifiable patient information into free-text fields or attempt to re-identify anonymous data outputs.
- The Tool is not intended for emergency situations, and users should rely on standard emergency protocols.
- Any personalized data or outputs may only be accessed by the individual User and not shared with unauthorized parties. Outputs indicate potential root causes but are not conclusive findings.
- Codewave/Aihiki has no liability related to User-provided inputs, interpretation of outputs for medical purposes, clinical decision making, or patient outcomes associated with use of this Tool.
Ownership and Access –
- Codewave/Aihiki retains all ownership over the Tool, including underlying source code, data models, algorithms and system implementation. Users have a limited license to access and use the Tool according to these Terms and Conditions.
- Codewave/Aihiki may discontinue or suspend access to the Tool at any time. Codewave/Aihiki may also revoke or disable individual user accounts if Terms and Conditions are violated.
- Users will not attempt to reverse engineer, bypass security controls, perform unauthorized penetration testing, access source code or system infrastructure, or violate the security of the Tool.
Warranty Disclaimer –
The Tool and outputs are provided “as is” without warranty of any kind. Codewave/Aihiki disclaims all warranties, express or implied, concerning accuracy, result integrity, completeness, timeliness, and fitness for a particular purpose with respect to the Tool.
Limitation of Liability –
In no event shall Codewave/Aihiki be liable concerning the Tool for indirect, special, incidental or consequential damages such as loss of profits or inability to use the Tool even if advised of the possibility of such damages.
Indemnification –
Users agree to indemnify and hold harmless Codewave/Aihiki from any claims, damages, liabilities, and all associated expenses arising from – (a) User’s failure to comply with applicable laws or these Terms and Conditions; (b) Patient privacy breaches or any unauthorized use or disclosure of identifiable patient data by Users; or (c) Claims associated with clinical decision making, patient treatment, or medical malpractice related to Users’ utilization of the Tool’s outputs.
Governing Law –
These Terms shall be governed by the laws of India. Any disputes shall be subject to exclusive jurisdiction of Bangalore, India (Bengaluru) courts.
Changes to Terms –
Codewave/Aihiki may update these Terms of Use from time to time. If we make material changes, we will notify you by email that changes have been made. Your continued use of the Tool signifies acceptance of amended terms.
